Shine Card Programme Conditions of Use


Account means the account provided to you in order to operate the Shine Recognition Programme and view transactions made using the Card.
Cardmeans any card issued to you as part of the Shine Recognition Programme.
Card Holder means a person authorised by HSBC to use the Card
HSBC means HSBC Bank plc, 8 Canada Square, London, E14 5HQ
You, Your means the cardholder
‘We’, ‘our’, ‘us’ means HSBC
All references to the use of the Chip & PIN Card also refer to the use of your Card details and any related Personal Identification Number (‘PIN’).

These Conditions of Use should be read in conjunction with:

  • The activation instructions notified to you by email
  • The Shine policy and procedures accessible via the Shine intranet site
  • The Data Privacy Statement accessible via the Shine intranet site

1. Issuing of cards and authorising transactions


1.1 These Conditions govern the use by you, the Cardholder of the Card provided to you by HSBC Bank plc for the purposes of a corporate recognition award Card to be used by managers for the benefit of their employees (Shine Recognition Programme).
1.2 You may use your Card as a means of payment to purchase goods and services from merchants, in relation to the Shine Recognition Programme, provided that there are sufficient funds available on your Card and your Card is valid and has not been cancelled. The card must not be used for illegal purposes, or for cash withdrawals from ATM machines, foreign currency purchases, travellers’ cheques, Cash back or Point of Sale transactions within the following merchant categories:
  • 5542 - Automated Fuel Dispensers
  • 7995 - Betting (including Lottery Tickets), Casino Gaming Chips, Off-Track Betting and Wagers
  • 9752 - U.K. Petrol Stations
1.3 Cards may be used and transactions may be authorised by you using, as the circumstances require, any combination of the Card, PIN or other Card security details or in other ways advised to you by us and subject to these Terms until the Card expiry date. Where a chip and PIN Card is used, a Cardholder must use a PIN to authorise a transaction unless the transaction is executed at a distance, for example over the internet, in which case other security features advised to you must be used to authenticate the transaction. We may allow you to authorise a transaction after it has taken place. Transactions authorised by you to or via a supplier or retailer will not be immediately notified to us. If we receive notification of a transaction outside normal business hours then it will be deemed to have been received by us by the end of the next business day.
1.4 Your authorisation for a transaction cannot be withdrawn once it is given to us or the payee. Where authorisation is given for a series of transactions in advance of when they are to occur, consent may be withdrawn by you up to the end of the business day before the transaction is to occur.
1.5 The amount of any transaction on the Account will be debited or credited, as relevant, to the payee’s bank or payment service provider before the end of the third business day following of our receipt of notice of the transaction or after that date by the end of the first business day following receipt of the notice. However, this will not apply to transactions made in currencies other than Sterling or Euro or which involve more than one currency conversion between Euro and Sterling. Transactions made using paper-based authorisation methods will take one day longer.
1.6 You will not receive a paper statement, however, you can view your current balance on the Account and recent transactions via at www.shinecard.co.uk or at the SHINE intranet site. Alternatively you can call White Eagle Customer Services. The Account will show details of those transactions and other movements. You must tell us immediately if any item shown on your statement is incorrect. In some instances, details of a transaction may be provided separately to you but in this case your statement will show at least the amount and date of that transaction.

2. Using your Card

2.1 You must only use the Card during the validity period shown for amounts up to the amount of money on the Card.
2.2 Your Card may be loaded by HSBC only. Card limits will be notified to you by your business area in line with each business area’s appropriate communication channel. You can also check with your Business Area Shine Champion, and see the amount loaded by accessing your Account online. Funds on your card will not earn interest.
2.3 The Card must not be used if cancelled or suspended. The Card remains HSBC’s property and must be returned upon request. You must return the card upon termination of your employment or when we instruct you to do so.
2.4 We can cancel or suspend the use of all or any Cards for all or any purposes or refuse to replace or reissue all or any Cards if:
(a) we have reasonable grounds for suspecting fraudulent or unauthorised use of the Card; or
(b) we have reason to believe that the security of the Card or Card details has been compromised.
2.5 You may not rescind or revoke a Purchase or other transaction using the Card or Card details once the transaction authorisation has been received by us or the payee (for example, a retailer or supplier). We will credit the Account with a refund only if the payee refunds us.
2.6 Provided that you have correctly authorised a transaction, we will be responsible for the correct execution of the payment to the payee except where we can prove that the payee’s bank or service provider received the transaction funds.
2.7 Where you authorise a transaction and the amount of the transaction is not specified when the authorisation is given then if the amount of that particular transaction is unexpectedly higher than could reasonably be expected in the circumstances we will investigate and, if required, provide a refund of the amount and apply the transaction as originally authorised by you. This will not apply where you have given consent for the transaction directly to us and, if applicable, the information on the transaction was provided to you by any means at least four weeks before the transaction was executed.

3. Looking after your Card


3.1 You must take all reasonable precautions to prevent fraudulent use including the following:
a) sign the Card immediately on receipt;
b) do not let any other person use the Card;
c) treat the Card like cash, never leave it unattended;
d) if the Card is used to pay for goods and services through the Internet, Card details must be sent in encrypted form using the ‘secure session’ features which are included in the current versions of Netscape and Microsoft browsers.
The use of the Card to place orders or make payments through the Internet is otherwise not permitted and Card details must never be sent in uncoded form on the Internet.
3.2 If the Card is lost or stolen, or you suspect fraudulent use, you or the Customer must notify us as soon as the loss, theft or fraudulent use has been discovered, by telephoning the UK Shine Card customer service number : +44 (0) 207 081 0862, or by emailing customerservice@shinecard.co.uk
3.3 You must co-operate with us and the police in any investigation into the loss, theft or possible misuse of the Card. We will disclose information to third parties about you, the Customer and relevant accounts if we think it will help avoid or recover loss. Should you retrieve the Card after it has been reported lost or stolen, it must not be used but sent to us cut in half vertically.

4. Liability for Unauthorised Transactions

4.1 If someone else obtains the Card or Card details with your consent, you will be liable for any use made of the Card by that person or anyone else, even if you have not authorised it, until you notify us under Clause 3.2. If someone else uses the Card or Card details with your consent, you will be liable for such use.
4.2 If we can show that you have acted fraudulently, you will be responsible for all losses without limit.
4.3 We may need your written notification that an item on your Account is not your transaction before we are able to process any refund to which you may be entitled.

5. Looking after your PIN


5.1 We will issue you with a PIN which you can retrieve online at www.shinecard.co.uk or via our automated telephone system. We will not reveal your PIN to anyone but you. You may also be asked by a retailer and other supplier to enter your PIN into a secure PIN pad when you pay in person for goods and services with your Card.
(a) Please note that if you enter an incorrect PIN three times consecutively on the premises of a retailer or other supplier, your PIN will “lock” for use with retailers or other suppliers. You can “unlock” it using the correct PIN at an ATM in the UK, Channel Islands and Isle of Man.
(b) If you still cannot remember the correct PIN, or are abroad, you will need to telephone Shine Card customer services on +44 (0) 207 081 0862 or log onto www.shinecard.co.uk for instructions about retrieving your PIN number.
(c) You can change your PIN if you wish, but you must comply with Clauses (a) and (b) above.
5.2 All reasonable precautions must be taken to prevent fraudulent use of any PIN issued for use with the Card including the following: • Never write your PIN on the Card or on any other item normally kept with your Card • Never record your PIN in such a way that can be easily understood by someone else • Never tell your PIN to someone else • Inform us immediately if you suspect someone else knows your PIN (refer to 4 above) • Destroy your PIN advice promptly after receipt • If you change your PIN, do not use a number which may be easy to guess, e.g., 1234, 4444, your date of birth or telephone number.

6. General

6.1 We will not be liable if any retailer, supplier or Bank refuses to accept a card. 6.2 The account will operate in Sterling and all communications under this Agreement will be in English. Any foreign currency transactions are converted to Sterling by MasterCard using an exchange rate based on wholesale market rates applying on the day the conversion is made. 7. Confidentiality

Information we hold about you will not be disclosed to anyone other than where:
  • We are legally required to disclose, or
  • We have a public duty to disclose, or
  • The disclosure is made with your consent
